Petition: China, Free Citizen Journalist Zhang Zhan Unconditionally NOW

众所周知，由于中国当局隐瞒导致新冠肺炎疫情扩散，2020年全球遭受了巨大的生命和财产损失。同时，中国政府持续致力于打击揭露真相的普通民众，这其中包括训诫率先向外界披露疫情并因新冠肺炎而去世的“吹哨人”李文亮医生, 以及秘密羁押以陈秋实、方斌、李泽华和张展为代表的公民记者。其中，方斌至今仍生死未明；张展于2020年5月被拘留，在看守所中绝食抗议已超过6个月，遭到强制灌食、24小时捆绑约束带等酷刑长达数月。张展的辩护律师说她非常瘦弱，身体很差。

As we all know, because the Chinese authorities hid crucial information about the COVID-19 outbreak, the world has suffered huge losses of life in 2020. Meanwhile, the Chinese government continues to punish ordinary people of China who reveal the truth. This includes the reprimand of “the whistle-blower” Dr. Li Wenliang, who was among the first people to disclose the epidemic to the public and subsequently died of COVID-19, and the secret detention of citizen journalists Chen Qiushi, Fang Bin, Li Zehua and Zhang Zhan. Fang Bin has been missing to this day; it is not known whether he is alive or dead. Zhang Zhan has been on a hunger strike for over 6 months after being detained in May; she has been subjected to torture such as force-feeding and being put in restraints 24 hours a day for months. Zhang Zhan’s lawyers say that she is in very poor health.

2020年12月28日，在举世瞩目及各界反对声中，因独立报道早期武汉新冠肺炎疫情，公民记者张展被上海浦东新区法院以“寻衅滋事罪”判处四年监禁。她是自新冠肺炎疫情爆发以来首位公开因言而获重刑的中国公民记者，也是中共企图进一步阻挠揭露疫情真相的又一突破底线的行动。

On December 28, 2020, amidst worldwide attention and condemnation, citizen journalist Zhang Zhan was sentenced to four years by the Shanghai Pudong New District Court for “picking quarrels and provoking troubles” over her independent reporting on the early Wuhan Covid-19 pandemic.She is the first Chinese citizen journalist who has been publicly handed a severe sentence for her reporting since the outbreak of the pandemic. This is another attempt by the Chinese Communist Party (CCP) to further block the disclosure of the truth of the epidemic.

我们，作为一群坚持民主宪政价值理念的青年，强烈认为公民独立报道属于基本的言论自由实践，是任何公权力和个人都不可将其剥夺的基本人权。以张展等为代表的公民记者群体，有权不受限制的行使宪法保护下的言论自由权利。对张展的审判，是中国共产党及其附属的中华人民共和国政府压制言论自由，侵害公民基本人权，并以此为借口对公民进行人身迫害的又一例证。我们对此表示强烈愤慨与谴责。

We are a group of young people who believe in the values of democracy and constitutionalism. We firmly believe that independent reporting is a basic practice of freedom of speech, a basic human right that cannot be deprived of by any public power or individual. Zhang Zhan and others have the right to exercise their freedom of speech under the protection of China’s Constitution without restriction. The trial of Zhang Zhan is another example of suppressing freedom of speech and violating the basic human rights of citizens by the CCP and its affiliated government of the People’s Republic of China, who employ this to persecute citizens. We express our strong indignation and condemnation.

我们强烈呼吁中国政府立即无条件释放张展，并对相关法律适用展开违宪调查，同时对张展因任意羁押而造成的身心损害进行国家赔偿。

We strongly urge the Chinese government to release Zhang Zhan immediately and unconditionally, to conduct an investigation into the application of relevant laws for unconstitutional purposes, and to provide state compensation for the physical and mental harm suffered by Zhang Zhan during her arbitrary detention.

我们强烈呼吁各国政府及国际组织立即启动马格尼茨基法案或相关人权法案，对相关中国上海当局公、检、法及党政的张展案涉案人员进行制裁。

We strongly urge all governments and international organizations to immediately activate the Magnitsky Act or related human rights bills to impose sanctions on the relevant police, prosecutors, judges, and the CCP and government officials involved in the persecution of Zhang Zhan.

最后，我们强烈呼吁中国政府立即释放所有因言获罪的在审及待审公民；建立宪法审查委员会，废除侵害公民言论自由等基本人权的法律；切实落实保护人权的承诺，禁止秘密羁押及酷刑。

Finally, we strongly urge the Chinese government to immediately release all citizens under or awaiting trial who have been convicted because of their speech; to establish a constitutional review committee to abolish laws that violate citizens’ freedom of speech and other basic human rights; and to truly protect human rights and prohibit secret detention and torture.

张展，陕西咸阳人，前律师及中国持不同政见人士。张展于2020年2月初赶往新冠肺炎病毒爆发地中国湖北省武汉市，以独立公民记者身份报导当地疫情危机。她质疑当局对疫情的回应措施侵犯人权。她为李文亮医生发声，并质疑当局掩盖疫情的严重性。她对那些失去生计而贫困潦倒、不能发声的普通的武汉人深感关切。当另外三名公民记者陈秋实、方斌和李泽华相继失踪时，这位勇敢的女性仍旧坚守，直到2020年5月14日上海警方将她从武汉的旅馆带走。2020年9月初据媒体报道，张展在浦东看守所绝食输液，身体虚弱。中国的监狱普遍对绝食者进行强迫灌食，这是一种极可怕、屈辱的折磨。2020年12月28日，上海浦东新区法院以“寻衅滋事罪”判处张展入狱4年。此前，张展长期关注和参与维权活动，曾因在中国大陆公开追求民主自由和公民权利、声援香港的“反逃犯条例”示威运动而于2019年在上海两次被捕，在被拘留的65天中遭受严重的虐待。
